Major Change in Alberta Family Law as of January 1, 2020

As of January 1, 2020, Alberta’s Matrimonial Property Act will become the Family Property Act. This legislation used to apply only to the property of married couples upon separation. As of January 1, 2020, it will also apply to adult interdependent partners (often called “common law couples”) upon separation. Information about this change is available on the Alberta government website.

This change will have a significant impact on many Albertans.  Determining whether a relationship is an adult interdependent relationship and whether the Family Property Act will apply can be complex.  We recommend that anyone concerned about how this change may impact their individual situation seek legal advice.
